These Terms of Business (“Terms”) govern your access to and use of the Mendara platform (the “Platform”). By registering for or using the Platform, you agree to be bound by these Terms.
About the Platform
Mendara provides a peer-to-peer support platform in which participants engage in facilitated group sessions and access related resources.
The Platform is designed to enable individuals to share experiences and receive peer support in a structured and anonymised environment.
The services may be accessed:
free of charge (for certain resources);
on a pay-as-you-go basis; and/or
via a short-term subscription (including a seven-day experience),
as further described on the Platform.
Important Disclaimer – Nature of Service
The Platform provides peer-to-peer support only.
Mendara does not provide:
medical advice;
mental health treatment;
counselling services; or
any form of clinical or professional advice.
No facilitator or other participant is acting as a regulated professional.
You acknowledge and agree that:
participation is voluntary;
any information shared within sessions is not professional advice; and
you are solely responsible for any decisions you make based on your participation.
Eligibility and Registration
To access the Platform, you must register and provide the requested information.
As part of onboarding, you will complete a questionnaire designed to assist in directing you to appropriate forums.
You agree that:
information you provide is accurate and not misleading; and
you will not attempt to identify other participants.
Sessions
The core service consists of facilitated sessions conducted in an anonymised format.
Sessions are led by trained facilitators.
Mendara reserves the right to:
allocate participants to sessions;
change session formats; and
determine participant suitability.
Suitability and Referrals
The Platform is not suitable for individuals requiring clinical or specialist support.
Where a facilitator reasonably considers that:
a participant requires professional support; or
continued participation may be inappropriate,
the facilitator may:
recommend external support services; and/or
remove the participant from a session.
Mendara accepts no liability for any failure to identify or respond to a participant’s needs.
Code of Conduct
You agree to:
respect the anonymity and confidentiality of all participants;
engage respectfully and constructively;
be empathetic to the other participants;
not share harmful, abusive, or inappropriate content;
not record, copy, or distribute session content;
not attempt to identify other participants.
Prohibited behaviour includes:
harassment or discrimination;
harmful or triggering conduct;
misuse of the Platform.
Mendara may suspend or terminate access for breach of this clause.
Fees and Payment
Fees (if applicable) are as set out on the Platform.
Payments are processed via a third-party provider (currently Stripe).
You agree that:
payments are due in advance;
except at our discretion fees are non-refundable except as required by law or stated otherwise;
subscriptions (if applicable) will be charged in accordance with the plan selected.
Mendara is not responsible for payment processing errors caused by third-party providers.
Data and Recording
Sessions may be recorded.
By participating, you consent to:
recording of sessions;
creation of transcripts; and
analysis of session data for the purposes described in the Privacy Policy.
Intellectual Property
All content on the Platform is owned by or licensed to Mendara.
You may access content solely for personal, non-commercial use.
You must not:
copy or reproduce materials;
distribute or exploit content;
create derivative works from session materials.
Availability
Mendara does not guarantee uninterrupted access to the Platform.
The Platform may be modified, suspended, or withdrawn at any time.
Limitation of Liability
Nothing in these Terms excludes liability where it cannot be excluded by law in particular death or personal injury caused by our negligence) fraud or fraudulent misrepresentation
We do not exclude or limit your statutory rights, including your rights in relation to services not carried out with reasonable care and skill.
Subject to the provisions of this clause 11 we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into these terms.
To the fullest extent permitted by law, Mendara shall not be liable for:
any reliance on peer discussions;
emotional or psychological outcomes;
Mendara’s total liability shall not exceed the amount paid by you in the preceding 12 months.
Termination
You may stop using the Platform at any time.
Mendara may suspend or terminate your access:
for breach of these Terms;
where necessary for safeguarding; or
at its discretion.
The Terms
The Terms sets out the entire agreement between us and any emails, other communication or website content will not be included in these Terms.
Mendara may update these Terms from time to time but will inform you. Continued use of the Platform constitutes acceptance of updated Terms.
THIRD PARTY RIGHTS
The Contracts (Rights of Third Parties) Act 1999 is excluded.
Governing Law
These Terms are governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.
